Council APPROVED the application at OM 20 Mar 2025 (Stockwell/Finzel) with amended conditions: minimum 375 sqm landscaping and 1 m soft landscaping to street frontages, at most 5 "Tide" shade structures within the site, on-site refuse collection, and (Wilkie/Lorentson amendment) condition 40 requiring 56 car spaces and 10 motorcycle spaces, 29 marked for accommodation and 27 for the food and drink outlet. The applicant appealed those conditions (D44/2025). Council defended 19 Jun 2025, then at OM 20 Nov 2025 agreed to settle part on conditions in a confidential Attachment 1 and defend the rest. eTrack stage for MCU24/0074 now "Appeal Settled Judgment Issued", status "Development Permit" (checked 19 Sep 2026): the approval stands with conditions varied by consent order.
