No more than one Food and drink outlet is approved to operate at any one time and must be located in one tenancy only as identified on the approved plans of development. The Food and drink outlet must only operate between the hours of 7am and 9pm, 7 days per week. 4. Class sizes for the Indoor Recreation use are not to exceed 5 persons at any one time between the hours of 9am and 5pm. 5. All dwelling units must have a gross floor area of no more than 100m2 pursuant to the definition of a ‘small dwelling’ under the Noosa Plan 2020. 6. Service vehicle movements associated with non-residential uses on the premises (including loading and unloading) must not occur outside the hours of 7am to 6pm Monday to Saturday and not at all on Sundays or public holidays. The requirements of this condition must be included in the Community Management Statement for any body corporate for the subject site. Currency Period 7. This development approval lapses if the use has not happened by 17 February 2028, unless an application to extend the currency period is approved by Council. Building Height 8. The maximum height of the development must not exceed the building height and storeys shown on the approved plans. 9. Certification must be submitted to Council from a Licensed Surveyor which certifies that the buildings do not exceed the maximum height requirement of this Decision Notice. Performance Bond 10. Security in the form of a cash bond or trading bank guarantee to the sum of $30,000 must be submitted to Council, to secure performance of all conditions of this approval, prior to pre-start meeting. The cash bond or trading bank guarantee will be returned on performance of the conditions of approval less any costs incurred by Council in respect of enforcing performance of this permit. Council reserves the right to call upon the bond or guaranteed sum to effect compliance with conditions. Built form 11. All air conditioning units or other mechanical equipment must be fully enclosed or screened such that they are not visible from the street frontages nor adjoining properties. 12. All deck and balcony areas above ground floor must not be enclosed by permanent fixtures such as shutters, louvres, glass panelling or the like, except where required to satisfy any privacy condition of this Decision Notice. 13. External finishes must be as per the approved plans of development. 14. External colours must be muted environmental tones that blend with the natural environment. 15. The Energex PMT and the Fire hydrant booster must be finished in a colour that blends with the natural environment and the development. Communal Recreation Areas 16. Communal recreation area/s must be provided as shown on the approved plans of development. Street Identification 17. The street address of the development must be clearly visible and discernible from the primary frontage of the site by the provision of a street number and, where appropriate, the building name. Water & Sewer Connections 18. An underground connection to reticulated water and sewerage must be provided to the development site in accordance with the standards and requirements of Northern SEQ Distributor–Retailer Authority (Unitywater). 19. A Certificate of Completion from the Northern SEQ Distributor–Retailer Authority (Unitywater) must be submitted to Council that certifies an underground connection to reticulated water and sewerage has been provided to the development site. ENGINEERING Site Access and Driveways 20. Sealed access driveways must be provided from Doonella Street to all parking and manoeuvring areas of the development. The works must be undertaken in accordance with the conditions of this Decision Notice and must include in particular: a. driveway crossovers generally in accordance with Council’s standard drawing RS-051; b. suitable safety measures, including warning signage, to improve driver awareness of pedestrians and enhance pedestrian safety. Warning signage must be provided near the exit ramp from the parking area to warn motorists of pedestrian movement along the frontage street. Car Parking 21. Thirty three (33) car parking spaces must be provided and marked on the site and made available and accessible at all times. The works must be undertaken in accordance with the conditions of this Decision Notice and must include in particular: a. for the residential development, a maximum of 20 parking spaces within the total, which are clearly marked for that purpose and accessible at all times; and b. the balance of carparking for the commercial uses; and c. 12 motorcycle spaces; and d. disabled parking spaces as shown on the approved plans; and e. dimensions, crossfalls and gradients in accordance with Australian Standard AS2890: Parking Facilities. 22. All car parking areas and access driveways must be maintained exclusively for vehicle parking and manoeuvring and kept in a tidy and safe condition at all times. 23. Directional signage must be provided to direct visitors and customers to the car parking spaces provided on site. Pedestrian and Bicycle Facilities 24. Pedestrian and bicycle facilities must be provided for the development. The works must be undertaken in accordance with the conditions of this Decision Notice and must include in particular: a. a 2 metre wide concrete footpath within the road verge, the same colour as the existing (dark), for the entire length of the site’s frontage to Doonella Street; b. a 2m wide concrete pathway for the full length of the ‘public thoroughfare’ easement, along the full length of the easement located along the northern boundary c. pedestrian pathways between the proposed car parking area and the building/s; d. adequate separation of all specific pedestrian routes from vehicle access and manoeuvring areas, and clear demarcation by pavement marking, signposts or changes in surface materials or levels; e. signage and lighting at strategic locations to direct people to building entries and public toilet facilities; f. bicycle parking spaces and lockers as shown on the approved Ground / Carpark Plan (Plan SD02, Iss.12). Stormwater Drainage 25. The site must be provided with a stormwater drainage system connecting to a lawful point of discharge. The works must be undertaken in accordance with the conditions of this Decision Notice. Services 26. Unless otherwise stipulated by telecommunications legislation at the time of construction, the development must be provided with all necessary conduits, pits and pipes to accommodate the future connection of optic fibre technology telecommunications. 27. 27. Certification must be submitted to Council from all relevant service providers (Energex, NBN and Unitywater) which certifies that the development has met the requirements of this Decision Notice and all applicable legislation at the time of construction. Easements 28. A 3 metre wide easement for “Public Thoroughfare” must be registered against the title of the property in favour of Council. The easement must be located as shown, in red, on Drawing No. SD03, titled “Level 1 Plan”, Issue 10, dated 31/05/2021 and prepared by Archicology P/L. 29. Unless otherwise agreed in writing by the relevant service provider, any public or third party infrastructure located on the subject site must be placed within an easement registered against the title of the property. 30. All easements must be designed in accordance with the planning scheme and granted at no cost to the Grantee. Where the Grantee is Council or a service authority, the easement documentation must be in accordance with the Grantee’s standard easement terms. Draft easement documentation must be submitted to Council for endorsement. 31. All works must be kept clear of any existing or proposed easements on the subject land, unless agreed otherwise in writing by the Grantee. Geotechnical Stability 32. All works must be carried out generally in accordance with geotechnical investigation report 18151-001-Rev0, titled: “Proposed Commercial & Residential Development 30-32 Doonella St Tewantin”, dated 22 June 2018 and prepared by Tectonic Geotechnical and Environmental Engineers. 33. Certification must be submitted to Council from a qualified person* which certifies that the development has been constructed in accordance with the recommendations contained in geotechnical investigation report 18151-001-Rev0, titled: “Proposed Commercial & Residential Development 30-32 Doonella St Tewantin”, dated 22 June 2018 and prepared by Tectonic Geotechnical and Environmental Engineers, and that the development has a minimum factor of safety against landslip of 1.5 in the long term. *(Refer to advisory Note) Earthworks and Retaining Walls
